1. To-day I begin with a repetition of what I said before, and I BEG YOU TO BEAR IN MIND THAT GOVERNMENTS AND PEOPLE ARE CONTENT IN THE POLITICAL WITH OUTSIDE APPEARANCES. What do we care if the ranks of those striving for power should be thinned, if there should arise a deadlock from the impossibility of finding presidents, a deadlock which will finally disorganize the country?

In order that our scheme may produce this result we shall arrange elections in favor of such presidents as have in their past some dark, undiscovered stain, some “Panama” or other – then they will be trustworthy agents for the accomplishment of our plans out of fear of revelations and from the natural desire of everyone who has attained power, namely, the retention of the privileges, advantages and honor connected with the office of president.

14. It is easy to understand that in these conditions the key of the shrine will lie in our hands, and no one outside ourselves will any longer direct the force of legislation.

Besides this we shall, with the introduction of the new republican constitution, take from the Chamber the right of interpolation on government measures, on the pretext of preserving political secrecy, and, further, we shall by the new constitution reduce the number of representatives to a minimum, thereby proportionately reducing political passions and the passion for politics. 16. The president will, at our discretion, interpret the sense of such of the existing laws as admit of various interpretation; he will further annul them when we indicate to him the necessity to do so, besides this, he will have the right to propose temporary laws, and even new departures in the government constitutional working, the pretext both for the one and the other being the requirements for the supreme welfare of the State. 


17. By such measure we shall obtain the power of destroying little by little, step by step, all that at the outset when we enter on our rights, we are compelled to introduce into the constitutions of States to prepare for the transition to an imperceptible abolition of every kind of constitution, and then the time is come to turn every form of government into OUR DESPOTISM.


18. The recognition of our despot may also come before the destruction of the constitution; the moment for this recognition will come when the peoples, utterly wearied by the irregularities and incompetence – a matter which we shall arrange for – of their rulers, will clamor: “Away with them and give us one king over all the earth who will unite us and annihilate the causes of disorders – frontiers, nationalities, religions, State debts – who will give us peace and quiet which we cannot find under our rulers and representatives.”

20. But if we give the nations of the world a breathing space the moment we long for is hardly likely ever to arrive.


1. The State Council has been, as it were, the emphatic expression of the authority of the ruler: it will be, as the “show”part of the Legislative Corps, what may be called the editorial committee of the laws and decrees of the ruler.

2. This, then, is the program of the new constitution. We shall make Law, Right and Justice (1) in the guise of proposals to the Legislative Corps, (2) by decrees of the president under the guise of general regulations, of orders of the Senate and of resolutions of the State Council in the guise of ministerial orders, (3) and in case a suitable occasion should arise – in the form of a revolution in the State.

3. Having established approximately the MODUS AGENDI we will occupy ourselves with details of those combinations by which we have still to complete the revolution in the course of the machinery of State in the direction already indicated.

By these combinations I mean the freedom of the Press, the right of association, freedom of conscience, the voting principle, and many another that must disappear for ever from the memory of man, or undergo a radical alteration the day after the promulgation of the new constitution.

It is only at the moment that we shall be able at once to announce all our orders, for, afterwards, every noticeable alteration will be dangerous, for the following reasons: if this alteration be brought in with harsh severity and in a sense of severity and limitations, it may lead to a feeling of despair caused by fear of new alterations in the same direction; if, on the other hand, it be brought in a sense of further indulgences it will be said that we have recognized our own wrong-doing and this will destroy the prestige of the infallibility of our authority, or else it will be said that we have become alarmed and are compelled to show a yielding disposition, for which we shall get no thanks because it will be supposed to be compulsory … Both the one and the other are injurious to the prestige of the new constitution. What we want is that from the first moment of its promulgation, while the peoples of the world are still stunned by the accomplished fact of the revolution, still in a condition of terror and uncertainty, they should recognize once for all that we are so strong, so inexpugnable, so super-abundantly filled with power, that in no case shall we take any account of them, and so far from paying any attention to their opinions or wishes, we are ready and able to crush with irresistible power all expression or manifestation thereof at every moment and in every place, that we have seized at once everything we wanted and shall in no case divide our power with them … Then in fear and trembling they will close their eyes to everything, and be content to await what will be the end of it all.

8. God has granted to us, His Chosen People, the gift of the dispersion, and in this which appears in all eyes to be our weakness, has come forth all our strength, which has now brought us to the threshold of sovereignty over all the world.

For any attempt to attack us, if such still be possible, we shall inflict fines without mercy.

Such measures as stamp tax, deposit of caution-money and fines secured by these deposits, will bring in a huge income to the government. It is true that party organs might not spare money for the sake of publicity, but these we shall shut up at the second attack upon us. No one shall with impunity lay a finger on the aureole of our government infallibility. The pretext for stopping any publication will be the alleged plea that it is agitating the public mind without occasion or justification. I BEG YOU TO NOTE THAT AMONG THOSE MAKING ATTACKS UPON US WILL ALSO BE ORGANS ESTABLISHED BY US, BUT THEY WILL ATTACK EXCLUSIVELY POINTS THAT WE HAVE PRE-DETERMINED TO ALTER.



4. NOT A SINGLE ANNOUNCEMENT WILL REACH THE PUBLIC WITHOUT OUR CONTROL. Even now this is already being attained by us inasmuch as all news items are received by a few agencies, in whose offices they are focused from all parts of the world. These agencies will then be already entirely ours and will give publicity only to what we dictate to them.

6. Let us turn again to the FUTURE OF THE PRINTING PRESS. Every one desirous of being a publisher, librarian, or printer, will be obliged to provide himself with the diploma instituted therefore, which, in case of any fault, will be immediately impounded. With such measures THE INSTRUMENT OF THOUGHT WILL BECOME AN EDUCATIVE MEANS ON THE HANDS OF OUR GOVERNMENT, WHICH WILL NO LONGER ALLOW THE MASS OF THE NATION TO BE LED ASTRAY IN BY-WAYS AND FANTASIES ABOUT THE BLESSINGS OF PROGRESS. Is there any one of us who does not know that these phantom blessings are the direct roads to foolish imaginings which give birth to anarchical relations of men among themselves and towards authority, because progress, or rather the idea of progress, has introduced the conception of every kind of emancipation, but has failed to establish its limits …. All the so-called liberals are anarchists, if not in fact, at any rate in thought. Every one of them in hunting after phantoms of freedom, and falling exclusively into license, that is, into the anarchy of protest for the sake of protest….


7. We turn to the periodical press. We shall impose on it, as on all printed matter, stamp taxes per sheet and deposits of caution-money, and books of less than 30 sheets will pay double. We shall reckon them as pamphlets in order, on the one hand, to reduce the number of magazines, which are the worst form of printed poison, and, on the other, in order that this measure may force writers into such lengthy productions that they will be little read, especially as they will be costly. At the same time what we shall publish ourselves to influence mental development in the direction laid down for our profit will be cheap and will be read voraciously. The tax will bring vapid literary ambitions within bounds and the liability to penalties will make literary men dependent upon us. And if there should be any found who are desirous of writing against us, they will not find any person eager to print their productions. Before accepting any production for publication in print, the publisher or printer will have to apply to the authorities for permission to do so. Thus we shall know beforehand of all tricks preparing against us and shall nullify them by getting ahead with explanations on the subject treated of.

8. Literature and journalism are two of the most important educative forces, and therefore our government will become proprietor of the majority of the journals. This will neutralize the injurious influence of the privately-owned press and will put us in possession of a tremendous influence upon the public mind …. If we give permits for ten journals, we shall ourselves found thirty, and so on in the same proportion. This, however, must in no wise be suspected by the public. For which reason all journals published by us will be of the most opposite, in appearance, tendencies and opinions, thereby creating confidence in us and bringing over to us quite unsuspicious opponents, who will thus fall into our trap and be rendered harmless.

9. In the front rank will stand organs of an official character. They will always stand guard over our interests, and therefore their influence will be comparatively insignificant.

10. In the second rank will be the semi-official organs, whose part it will be to attack the tepid and indifferent.

11. In the third rank we shall set up our own, to all appearance, opposition, which, in at least one of its organs, will present what looks like the very antipodes to us. Our real opponents at heart will accept this simulated opposition as their own and will show us their cards.

12. All our newspapers will be of all possible complexions — aristocratic, republican, revolutionary, even anarchical – for so long, of course, as the constitution exists …. Like the Indian idol “Vishnu” they will have a hundred hands, and every one of them will have a finger on any one of the public opinions as required. When a pulse quickens these hands will lead opinion in the direction of our aims, for an excited patient loses all power of judgment and easily yields to suggestion. Those fools who will think they are repeating the opinion of a newspaper of their own camp will be repeating our opinion or any opinion that seems desirable for us. In the vain belief that they are following the organ of their party they will, in fact, follow the flag which we hang out for them.

13. In order to direct our newspaper militia in this sense we must take special and minute care in organizing this matter. Under the title of central department of the press we shall institute literary gatherings at which our agents will without attracting attention issue the orders and watchwords of the day. By discussing and controverting, but always superficially, without touching the essence of the matter, our organs will carry on a sham fight fusillade with the official newspapers solely for the purpose of giving occasion for us to express ourselves more fully than could well be done from the outset in official announcements, whenever, of course, that is to our advantage.

Methods of organization like these, imperceptible to the public eye but absolutely sure, are the best calculated to succeed in bringing the attention and the confidence of the public to the side of our government. Thanks to such methods we shall be in a position as from time to time may be required, to excite or to tranquillize the public mind on political questions, to persuade or to confuse, printing now truth, now lies, facts or their contradictions, according as they may be well or ill received, always very cautiously feeling our ground before stepping upon it …. WE SHALL HAVE A SURE TRIUMPH OVER OUR OPPONENTS SINCE THEY WILL NOT HAVE AT THEIR DISPOSITION ORGANS OF THE PRESS IN WHICH THEY CAN GIVE FULL AND FINAL EXPRESSION TO THEIR VIEWS owing to the aforesaid methods of dealing with the press. We shall not even need to refute them except very superficially.

16. Trial shots like these, fired by us in the third rank of our press, in case of need, will be energetically refuted by us in our semi-official organs.

Even nowadays, already, to take only the French press, there are forms which reveal masonic solidarity in acting on the watchword: all organs of the press are bound together by professional secrecy; like the augurs of old, not one of their numbers will give away the secret of his sources of information unless it be resolved to make announcement of them. Not one journalist will venture to betray this secret, for not one of them is ever admitted to practice literature unless his whole past has some disgraceful sore or other …. These sores would be immediately revealed. So long as they remain the secret of a few the prestige of the journalist attacks the majority of the country – the mob follow after him with enthusiasm.

18. Our calculations are especially extended to the provinces. It is indispensable for us to inflame there those hopes and impulses with which we could at any moment fall upon the capital, and we shall represent to the capitals that these expressions are the independent hopes and impulses of the provinces. Naturally, the source of them will be always one and the same – ours. WHAT WE NEED IS THAT, UNTIL SUCH TIME AS WE ARE IN THE PLENITUDE POWER, THE CAPITALS SHOULD FIND THEMSELVES STIFLED BY THE PROVINCIAL OPINION OF THE NATIONS, I.E., OF A MAJORITY ARRANGED BY OUR AGENTUR. Israel’s Prime Minister Benjamin Netanyahu was angered by UN Secretary General Ban Ki-Moon’s comments in his address to the Security council two weeks ago, when Ban said it was “human nature to react to occupation”. Netanyahu accused him of “stoking terror”, giving tacit justification for Palestinian violence. There are those who feel that Secretary Ban was guilty of much more than that.

In response to Ban’s comments, the Nascent Sanhedrin recently issued a proclamation calling for the State of Israel to leave the UN. The dispute is not over a point of international law, or even a point in the Middle East peace negotiations. Rather, the Sanhedrin reasons that it is fighting for the essential identity of Israel as the homeland of the Jewish People. They feel that the UN and Ban Ki-Moon are rejecting the validity of the Biblical covenant, and perhaps of the Bible itself. In the words of the Sanhedrin:

“Ban Ki-moon stands at the head of the organization called the UN, and the State of Israel continues to spurn its international rights and obligations concerning the Land of Israel as legally recognized in Article 80 of the UN Charter, which adopted all of the mandates of the League of Nations. To wit: The Land of Israel is solely the designated land of the Nation of Israel, and as such the Jewish state is therefore required to represent the interests of the Jewish People.

The Sanhedrin’s claim, that Ban accuses Israel of wresting the land away from the previous occupants – the alleged Palestinian nation – was actually anticipated by Judaism. It was predicted 900 years ago almost verbatim by one of the most prominent Jewish sages in history: a rabbi known as Rashi.

Rashi is an acronym for Rabbi Shlomo Yitzchaki, who was a French wine merchant who lived 900 years ago. A prolific scholar with commentaries on almost every piece of Jewish literature, including the Bible and the Talmud (the oral tradition), his commentaries present the basic meaning of the text in a concise and lucid fashion,and are therefore an essential part of Jewish study to this day.

Rashi’s commentary on the first verse of the Bible has always been considered enigmatic by scholars. While the Bible begins with the story of creation, and the verse, “In the beginning, God created the heavens and the earth…”, Rashi, who normally adheres to the simplest reading, sidestepped the central issue in an uncharacteristic manner, questioning why the Torah begins with the story of creation at all.

He answers his own question in a seemingly incongruous statement having nothing to do with the story of creation. He explains that the Torah first established that the world was created by God so that the non-Jews would not be able to claim that the Jews stole the land.

Rabbi Shimon Apisdorf, a noted Jewish speaker and award-winning author, spoke to Breaking Israel News about how this Rashi commentary applies to the current situation in the Middle East and to Ban in particular. Rabbi Apisdorf points out that Rashi, in almost prophetic fashion, predicted with unwavering conviction that the Jews would return to Israel. It was unimaginable that the Jews would actually have the opportunity to remind the world of their right to the land.

“It is amazing how closely Rashi’s description from 900 years ago fits the present political reality, but in a way it is not surprising. What Rashi is really saying is that we are at the heart of creation, and where we go, as long as our voice is united, the world will follow,” Rabbi Apisdorf told Breaking Israel News.

He explained, “When we accepted the Oslo Accords, we turned our backs on the claim that the land is ours, and only ours, by virtue of God’s covenant with Abraham. If the Jews don’t stand by that claim, why should anyone else?”

Rabbi Apisdorf’s solution was simple, and in a way, more shocking than that of the Sanhedrin.

“We don’t need to leave the UN. We need to reject the Oslo Accords, stand up at the UN, and make our claim in a loud, clear, and united voice. The purpose of this is first and foremost for the Nation of Israel, but it will impact the entire world.”

Given the turmoil and confusion the world finds itself in today, perhaps this is indeed the solution.

First Law is Courts


One of the most interesting things coming to mind when thinking about unveiling of righteous Mashiach (Messiah – Biblical language translation; may it happen soon, in our days) is definitely all-over-the-world reigning of Seven Laws Code of the peoples of the world – Noah Descendants – with establishment of courts and appointment of judges accompanying it.

It should be done in strict accordance with all nuances of Scripture and they are a lot. Let’s see what’s written about that in corresponding sources, such as RAMBAM‘s “Mishne Tora”, for example. It’s written there (“Mishne Tora” Religious Code, Laws of Kings and Their Wars 9:14):

“How is establishment of courts and appointment of judges Law observed? The peoples of the world must appoint judges and deans for each region and each town so that they judged on the basis of Six undermentioned Laws and warned people from infringement upon them. And the one who breaks one of those Seven Laws is to be sentenced to thedeath penalty with sword.

That is the one who worshipped idols, and the one who cursed the name of G-d, and the one who deliberately killed somebody, and the one who had banned sexual affair by one of six appropriate ways, and the one who robbed, even at the rate of fewer than the smallest coin value, and the one who ate flesh of any size from living creature, and the one who saw another infringe upon one of these Laws but didn’t bring him to the court – those are to be sentenced to the death penalty with sword. The capital sentence can be passed on the testimony of a single witness, by a single judge, and without the warning about punishment, and even on the testimony of relatives; only not by the testimony of woman, and woman may not be judge.”

This is a brief description of the only imperative Law – an attentive reader could already notice the other Six Laws have a prohibitive character. It’s not occasionally that Courts take first position among Seven Laws, coz without Courts’ establishment it’s just impossible to create an appropriate system of control for observation of the other Six Laws.

Now let’s approach Biblical source of all practical laws – Babylonian Talmud. It’s written there (Babylonian Talmud, Tractate Sanhedrin 56b):

“As it’s commanded to Israel to establish Batei-Dinin (courts – Biblical language translation) in each region and in each town, as it’s commanded to the peoples of the world to establish courts in each region and in each town.”

RASHI‘s comment explains Talmud means appointment of judges when speaking about establishment of courts for Israel. Tora‘s verses are adduced as a proof (Dvarim 16:18): “You shall set up judges and law enforcement officials for yourself in all your gateways.” Then RASHI says this Law refers to the peoples of the world as well since it’s written in Scripture (there): “…and they shall judge the people with righteous judgement.” But how is it commanded to Israel to appoint judges? RAMBAM writes (Sefer Hamitzvot, Imperative Commandment 176): “This is an imperative to appoint judges and law enforcement officials who will ensure observation of Tora’s laws, returning those stumbled into true way, directing people to good deeds and warning them from bad deeds. And they will set up fences guarding against infringements, so that following after Tora’s imperatives and prohibitions would not be defined by world-outlook of each separate person. And also law enforcement officials and inspectors who accomplish supervision in public places and control over financial operations so that there would be no lawlessness in the smallest deals.”

According to RAMBAM, the Law is being observed if judges are appointed and can judge on the basis of Six Laws. But Nahmanides (RAMBAN) writes in his comment on weekly Tora’s section Vayishlach, that, besides very judges, peoples of the world must establish courts by law branches – that is courts which will be occupied with hearing of cases referred to theft, fraud, oppression of hired worker, his wages, taking property for keeping, sexual violence and seduction, causing of property damage, arguments between lender and debtor, buying-selling deals and the like – in accordance with how it’s commanded to Israel about those courts. And the death penalty follows for such infringements like if one stole or delayed another’s wages, raped or seduced his neighbor’s daughter, set his sheaf on fire or damaged it.

Why death sentence may be passed by a single judge, and on the testimony of a single witness, without the warning about punishment, and even on the testimony of relatives? And why woman may be neither judge nor witness? The answer can be found in Talmud (Babylonian Talmud, Tractate Sanhedrin 57b):

“Rav Yehuda said it’s written in Scripture (Bereshit 9:5): But your blood, of your souls, I will demand – that is even by a single judge. From the hand of every beast – that is even without the warning about punishment – I will demand it. And from the hand of man – that is on the testimony of a single witness. From the hand of male – but not from the hand of female. His brother – that is even on the testimony of relatives, as far as rabbiIshmael said – even for fetus. What did he mean? It’s written (Bereshit 9:6): One who sheds the blood of man in man, shall his blood be shed. What is that man who is in man? He said – it’s fetus in mother’s womb.”

Further “Mishne Tora” says (“Mishne Tora” Religious Code, Laws of Kings and Their Wars 10:11 – Maimonides (RAMBAM)):

Beit-Din (court – Biblical language translation) of Israel is bound to prepare judges for “settlers” (Noah Descendants who have right to live in the Land of Israel – Author’s note), so that they judged according to those Laws and so that world did not perverted. If court of Israel found possible to appoint judges for them from them – appointed. But if it found necessary to appoint judges for them from Israel – done like this.”

RADBEZ‘s comment explains that if they themselves didn’t establish court for themselves, or there appeared to be no person among them who possessed necessary knowledge, then court of Israel must prepare judges for them. Let’s stop here for some more details.

Appointment of Judges

The claimant for the post of judge is taught and then carefully examined for competence in three spheres: Tora’s knowledge in sections corresponding to Bnei Noah, resourcefulness and ability to judge. If he possesses necessary abilities and level of knowledge, then he who before got appointment from the other judge declares to him: “You are appointed judge”.

The man who appointed unqualified judge is equated to him who planted Ashera (a special kind of tree planted by idolaters next to their temples). Coz, like idolatry, infringement upon justice leads to Shechina‘s (G-d’s presence – Biblical language translation) removal. And as the idol is false interpretation of Divine entity, as unexperienced or dishonest judge is some type of caricature on the concept of justice.

Six steps led the throne of king Solomon. They represented six prohibitions:

1. Not to pervert justice;

2. Not to display benevolence to any of litigants;

3. Not to take bribe;

4. Not to plant Ashera – that is not to appoint unworthy judges, coz he who appoints unqualified judge is equated to him who plants Ashera;

5. Not to set up Matzeva (a building for holding of idolatry rites) – that is not to appoint deans who are not G-dfearing people;

6. Not to bring sacrifices of animals with defects – that is to pray with full concentration and learn Tora with diligence. Read here about this.

General Prescriptions for Judges

Judge must imagine there’s a sword over him and Gehinom (hell – Biblical language translation) under him. If he is to judge fairly, neither a sword nor Gehinom will overtake him. But if not – both of them will overtake him.

Judge must not fear to pass wrong sentence coz of scarcity of facts. He is responsible only for the information he was given.

Judge is considered to be G-d’s associate in the act of creation and he is compared to firmament.

Judge can not base his opinion on the opinion of more authoritative judge or majority of judges, asserting: “Their decision is undoubtedly fair”. Judge is bound to understand the case on his own and to decide by conscience even if his decision doesn’t coincide with the decision of majority of judges. And if majority doesn’t agree with his opinion – he’s not responsible for consequences. One may freely act contrary to majority, coz “majority of people go after advice of Yetzer Hara (wicked origin)” (r. Itzhak Petersburger).

When holding trial, the defendant must be approached: “Stand up, so-and-so! And standing listen to the testimony of witnesses. You’re standing not in front of us but in front of Him Who created universe.”

Shotrim (law enforcement officials – Biblical language translation) help judges. They look after the execution of judges’ decisions.

It’s written in Tora (Shemot 23:7): “Distance yourself from a false matter”. It’s prescribed for the judge to avoid everything that may distort the correct way of his judgement.

It’s very important to prevent unfair judgement. If judge (or witness) is sure one of his colleagues is not honest, then he must refuse from cooperating with him.

If judge has an impression the witnesses lies but he can not prove it, he must leave judicial sitting but not to pass the sentence. He may not say: “I’m not responsible for that, it’s witnesses’ fault”.

Judge who understood he made a mistake must not aspire to find proofs to confirm false statements he made. He must not aspire to avoid confession of his fault.

If he who represents one of litigants is dressed elegant way and the other is dressed in rags, then both of them should be ordered to dress themselves similar way for trial. The objectivity of judge shouldn’t be influenced by their clothes.

The same way they both should be given with the equal quantity of time to give an account of their arguments and objections. It must not happen the way when, G-d forbid, important person is not interrupted and simple person is said: “OK, be shorter”.

It’s written in Tora (Shemot 23:8; Dvarim 16:19): “You shall not accept a bribe”. Judge is prohibited to take gifts from any of litigants. He’s bound to refuse even if the gift was presented with understanding he’s going to judge fairly and even if he has firm intention to judge true inspite of gift. Besides a tangible gift, bribery also includes any service or flattering word, judge can get or hear from any of litigants.

One must be careful and beware of judging the cases in which, according to the Sages’ opinion, judge may be even a little not objective. The nature of bribery is of such kind that it makes judge identify himself with him who gives bribe. Bribe-taker gets one of the following punishments: he either loses clarity of knowledge, or gets poor till he has to become a beggar, or fails eyesight.

Judge must prevent lawlessness in the community, or at least to protest against it. But if he keeps silence when he should protest, he will get Heavens’ punishment.

Judge is prohibited to be cursed or abused.

Report of Witness

Judge is prohibited to hear out the arguments of one of litigants when the other one is absent. Both litigants must be present simultaneously.

Tora says (Shemot 23:7): “Do not kill a truly innocent person or one who has been declared innocent”. If court passed death sentence and then somebody found new arguments in convict’s favour, or if he himself presented some new arguments in his defence – the trial is to be renewed even if sentenced person is already brought to execution’s site. The case is going to be reviewed as many times as essential arguments appear. But if some person is justified by court, his case is not renewed even if new proofs of his guilt are found.

It’s prohibited to execute death sentence based on indirect testimony, even if they are obvious and absolutely undoubted. According to Tora’s law, the sentence can be passed only on the basis of report of witness who watched the crime with his own eyes.

Judge must hear the direct testimony of single person. The testimony of mediators or indirect testimony can not be accepted. If, after careful learning of testimony, judge defines it is truthful, the sentence follows.

The court may not hear out the testimony of villain. That is, for example, someone who lets his cattle graze at someone else’s field, and someone who is professional player of games of chance – according to the list assembled by the Sages.

One may not lay indirect testimony, rumours or written report into the basis of his decision – only oral testimony of eye-witness who came into the court.

The witness is carefully interrogated by the judge. Halacha (practical law) means clear procedure of cross-examination. But if the witness gives false testimony so convincingly that even interrogation can find no deceit, then Tora doesn’t make the judge responsible for hidden facts he didn’t manage to unveil. And if finally the person was sentenced to the death penalty, it means there was some different sin upon him, and G-d deprived him of life this way.

If there are two witnesses who give contrary testimonies about happened event, then no testimony is accepted. But if the second one can prove the first one wasn’t present at locus delicti despite he states like that, then testimony of second witness is accepted providing he satisfactorily passed judicial verification. The witness may not give testimony about himself, thus first witness can not make such statement. But he may protect him by bringing a third witness who can confirm his presence at locus delicti.

False witness can be declared Ed Zomem (witness-malefactor – Biblical language translation). He is to be sentenced to the same punishment he wanted his victim to be done to. But it’s if witness’ malefactory was unveiled before the victim was put to death. If malefactory was unveiled after the execution of court’s sentence – he gets forty hits with knotted rope for false testimony. Tora says (Dvarim 19:19): “You shall do to him a he plotted to do to his brother” – that is he’s punished for his plot but not post factum

Second Law is No Blasphemy


The prohibition to curse the name of G-d is meant by No Blasphemy Law. That means any name used to call G-d in any language. The meaning of the prohibition refers to man who must accept humbly and thankfully everything that happens in his life and remember Hashem is merciful and long-patient. His providence never leaves any of us. He’s the One Who leads and supports us. And each detail in our life is a part of His special plan regarding each of us. And if something’s going wrong and not the way we’d like it to be – it’s necessary to clearly understand this is Hashem’s will. He sure has some serious reasons why everything should be like this, not different way. And that all is for our sake.

This is the second one from Seven Laws, but in fact this is the very first prohibition. It is exactly what Talmud starts to discuss Seven Laws of Noah Descendants with, placing it in before all other Laws. Probably, coz the Law means not only recognition of G-d (as it is meant by No Idolatry Law), but human’s full and absolute obedience to the will of G-d, as it can be understood from the previous paragraph. Then it becomes clear why No Blasphemy Law precedes much more actual, on the face of it, Law – No Idolatry. And even RAMBAM in his monumental work “Mishne Tora” places Blasphemy laws into Idolatry column, saying that both of them embody denial of universe and life foundations.

Now let’s approach Babylonian Talmud. What does it tell us about that fundamental prohibition (Babylonian Talmud, Tractate Sanhedrin 56a):

“The Sages teach: why is it written in Scripture – any man (written regarding No Blasphemy (Vayikra 24:15): Any man who blasphemes his G-d shall bear his sin –RASHI‘s comment)? To include the peoples of the world who should beware of Blasphemy the way Israel is commanded about that.”

How is Israel commanded about that (“Mishne Tora” Religious Code, Laws of Idolatry 2:8 – Maimonides (RAMBAM)):

“The warning about Blasphemy follows from Tora, as it’s written (Shemot 22:27): You shall not curse G-d. Each time Blasphemy case is brought before the court – the parable “May Yose strike Yose” is used (one of curse examples, where “Yose” substitutes for G-d’s names pronounced by a blasphemer – Author’s note). When the inquiry is over, all those present are asked to leave, and the most respected one from witnesses is asked to literally pronounce what he heard. He pronounces […], the second witness says: I heard the same he heard. And if there are many witnesses, each of them must say: I heard the same.”

RAMBAM writes the paragraph before (“Mishne Tora” Religious Code, Laws of Idolatry 2:7):

“A blasphemer is sentenced to the death penalty through throwing down onto stones only providing he pronounced the unique four-lettered Name of G-d and cursed it with one of non-erasable names, as it’s written (Vayikra 24:16): And one who blasphemously pronounces the Name of the L-rd shall be put to death, the entire community shall stone him, Ger (a person converted into Judaism – Biblical language translation) and resident (a Jew – Author’s note) alike if he pronounces the Name, he shall be put to death. For special Name – death penalty, for nick-names – only the warning that it’s prohibited.”

Now it is necessary to do some digression. The matter is one can find in Bible the great number of names used to call G-d. All them are subdivided into two groups. So called special four-lettered Name consists from letters הויה and has the highest holiness. It was allowed to pronounce only in Jerusalem Temple. Now when there’s no Temple, its pronunciation is strictly prohibited. In English it is usually translated as the L-rd. Nick-names are seven special names of G-d in Biblical language, which are allowed to say only during the prayer and Tora’s studies, and which are prohibited to erase from any place they were written at, and all the rest names of G-d that can be met in TaNaCh, like Kindful, Merciful etc.

All that – regarding Israel. However regarding the peoples of the world, RAMBAM writes (“Mishne Tora” Religious Code, Laws of Kings and Their Wars 9:3):

“Noah Descendant who cursed G-d – either he cursed the special four-lettered Name or he cursed the nick-name in any language – is to be sentenced to the death penalty. What is not like that as for Israel.”

But why is the law severer to the peoples of the world? Talmud explains (Babylonian Talmud, Tractate Sanhedrin 56a):

“Rabbi Itzhak Napaha said: it’s said to include the nick-names (regarding written in Scripture (Vayikra 24:15): Any man who blasphemes his G-d – it’s written to include the nick-names into No Blasphemy, so that the peoples of the world would beware of Blasphemy the way Israel is commanded about that; coz where all Seven Laws are taken from, there only prohibition to curse the special four-lettered Name follows, for it’s written the L-rd, and G-d is interpreted as No Idolatry Law – RASHI‘s comment). But according to rabbi Meir‘s opinion, the teaching (Vayikra 24:15): Any man who blasphemes his G-d shall bear his sin – what does Tora’s text speak about? For it’s already said (Vayikra 24:16): And one who blasphemously pronounces the Name of the L-rd shall be put to the death. As far as it’s written: And one who blasphemously pronounces the Name shall be put to the death – there can be understood that the human (both Israel and peoples of the world – Author’s note) is to be sentenced to the death only for special four-lettered Name. Where from can it be seen the nick-names are included? Tora’s text teaches: Any man who blasphemes his G-d – that is at any case. And this is rabbi Meir‘s opinion but the Sages said: for the special four-lettered Name – capital punishment, and for the nick-names – the warning. And that differs with rabbi Meisha‘s opinion. For rabbi Meisha told the Sages: Noah Descendant who cursed G-d with one of the nick-names is to be sentenced to the death. What Tora’s lines does his opinion leans on? (Vayikra 24:16): Ger and resident alike if he pronounces the Name, he shall be put to death. It can be seen from here that Ger and resident are sentenced to the death only for the special four-lettered Name, but Noah Descendant – even for the nick-name. But for rabbi Meir the line “Ger and resident alike” serves only to mark the difference in punishment. Ger and resident – by the death penalty through throwing down onto stones, but Noah Descendant – by the death penalty with sword (that is, according to rabbi Meir, both Ger and resident and Noah Descendant are to be sentenced to the death for the nick-names; they all were included by phrase “any man”, that is Ger and resident are equalized with Noah Descendants – RASHI‘s comment). It can come to your head to say that as far as they were included (in this section, all of them as those to be sentenced to the death for the nick-names – RASHI‘s comment), then they were included (also into everything written in the section, with the death penalty through throwing down onto stones – RASHI‘s comment). That’s why it was explained to you! And for rabbi Itzhak Napaha and the Sages, whom his opinion is conformed with, the line “Ger and resident alike” is adduced coz Ger and resident need the special four-lettered Name, but Noah Descendant doesn’t need it. Why then it’s written “any man”? This expression in Tora is spoken and it doesn’t carry any special semantic load.”

All names used to call G-d in all languages except for Biblical are the nick-names, according to Tora’s law. Thus, as for English, No Blasphemy strictly prohibits pronouncing the phrases like “G-d damn it” and using the nick-names mixed with really bad words and their combinations. It is also prohibited to curse G-d with names of idols, to take names “G-d” and “L-rd” in vain, and in general to speak scornfully about Creator of all existing, Who supports and refreshes the life in every one of us each single moment.

What about abuse of the Noahide Pledge?

Question: What about abuse of the Noahide Pledge

Recently, the beis din has heard objections on the part of Noahides concerning the potential abuse of the declaration by missionaries and those who might take the oath for ulterior motives. The suggestion was made to cross-examine applicants as the their beliefs.

Answer. The functions of a beis din does not include investigation. Evidence is to be brought to the court by the sides to a dispute, and related to by the court – very much like a court in the anglo-saxon tradition. The court does not investigate. It has no means of investigation.

The tradition is that a beis din hears claims, witnesses, reviews documents, issues decisions, presents documents to the sides in a case and a few other documents of the courts decision. In the classical case of convert a beis din makes the decision if to accept the convert after talking with the convert and being convinced in one or more face to face meetings that the convert is not lying. In the case of converts as a rule the strength of the motivation of the candidate is tried by refusing to convert him or her at the first request, although this is often waived if there is good reason to believe that the request to convert is Bona-Fide.

In an attempt to provide the most minimal bona-fide test of a applicant, it was decided by the court of Rabbi Schwartz in Jerusalem to include in the declaration which our beis din will require for a person with christian background, that “that person” is not and was not any part of a divinity, and was not a messiah.

This however is not a halachic statement concerning these beliefs. The beis din of Rabbi Schwartz in Jerusalem has issued no ruling on these issues.

What about those who hold “that person” is messiah?

Question: What about those who hold “that person” is messiah?

People who hold that he is not and was not any part of a divinity, but still holds that he was a messiah.

Answer: It is the opinion of Rabbi Schwartz that a person who believes that “that man” was a messiah is not transgressing any prohibition. However the issue is as follows: someone who believes that “that man” was a messiah seems to be only partly disassociating himself from full christianity, and there is a problem of what is meant by the term “messiah”. Is the messiah a “divine messenger” to “save” the world. Now when I say “a divine messenger” I mean someone – otherwise normal human being – sent by “the divinity” as a messenger. It seems that some people mean “a person with divine attributes”!

An issue which could be seen as semantic becomes of major consequence.

The decision of Rabbi Schwartz is therefore that in the beis din over which he presides he will not accept declarations of people with christian background if they think that “that man” was a messiah. This DOES NOT MEAN that the declaration of such a person before any [other] beis din is valueless. Perhaps another beis din will be satisfied that the person before them is bona fide in acceptance of the totally non-divinity of “that man”. They may accept the declaration, and it will be fully valid.

Alaskan Rabbi Opens U.S. Senate

Chabad Rabbi Yosef Greenberg was the 3rd Alaskan in history to open a session of the U.S. Senate in Washington, DC, with a prayer.

Rabbi Yosef Greenberg, Director of the Lubavitch Jewish Center of Alaska in Anchorage, has been designated as Guest Chaplain of the United States Senate on Wednesday, February 3rd.

Rabbi Greenberg traveled to Washington, DC, to deliver the daily prayer at the opening of Wednesday’s session of the U.S. Senate.

He was only the third Alaskan to serve as Guest Chaplain, with Reverend Norman H.V. Elliott serving in both 1999 and 2004. Guest Chaplains are recommended by Senators to deliver the session’s opening prayer in place of the Senate Chaplain.

Rabbi Greenberg was nominated for this honor by Senator Lisa Murkowski, and is the first Rabbi from Alaska to serve as Guest Chaplain for the U.S. Senate. The prayer was televised live on C-SPAN2.

“This is an incredible honor for not just Alaska’s Jewish community, but for the entire state of Alaska, for Rabbi Greenberg to open the U.S. Senate in prayer—a time-honored tradition,” said Senator Murkowski.

“Rabbi Greenberg and his wife Esty have been tremendous forces revitalizing Jewish communities throughout Alaska. He was not only the driving force behind creation of Alaska’s first Jewish history museum, but is also known throughout the state for his inclusiveness.”

Rabbi Greenberg was also Senator Murkowski’s guest at the interdenominational National Prayer Breakfast on Thursday, February 4th.

When I stumbled upon your webpage with what you claimed where quotes from the Talmud, I thought I would assist you in correcting your mistakes so that you may have an accurate understanding of what you clearly did not. However, after scrolling down I noticed that many of these books, “tractates”, whatever you want to call them don’t even exist. You even use the name of a 10th century commentator as a book. Here are accurate answers:

The lulav is not a trophy, it is a symbolism of uniting the Jews and hoping us all to possess good deeds and torah. Goy doesn’t equate heathen, impious, etc. Goy translates to any gentile nation. There is nothing more to that. If the Talmud ever refers to idolators, heathens, impious people it is referring to anyone, including Jews, that encapsulates these qualities. The Mount Sinai story recounts the receiving of the ten commandments and also of Jews who became idolators.. Its a well known story of the torah so I don’t understand how you can get that one wrong. There are 3 things, according to Talmudic Law, a Jew must never do, even if threatened by death. The three things are idolatry, sexual crimes and murder. These apply to all people. This sacred law alone discounts over half of your claims. Lastly, Kol Nidre isn’t a prayer and it only applies to specific vows made between 2 Jews. Any other vow that exists outside the jewish judicial system must still be upheld. Its difficult to give you the benefit of the doubt, attributed by ignorance, when outright lies are printed to be true. All I can hope is that you can accept that you were wrong, if you were simply making ignorant mistakes, and update your website to a truthful standing. If you are a self-titled truth teller, you should tell the truth.

At first glance, Mardi Gras — the New Orleans version of the worldwide Carnival celebrations — seems anything but Jewish. Its quintessential elements, including public masquerade, the imbibing of copious amounts of alcoholic beverages, and second-line parade music aren’t stereotypical territory for the people of the book, outside of a few bar mitzvah parties that went on way too long.

On second glance, however, Mardi Gras — which takes place this year in February takes on a different cast. A Jewish one.


For one, there is the holiday’s proximity in the calendar to the Jewish festival of Purim. And just as Easter has elements of Passover, and Christmas is basically Hanukkah 2.0, so too does Mardi Gras resemble Purim in more ways than one.

In fact, masquerading, drinking, making noise and all sorts of revelry are essential elements of Purim, one of the only days of the year when Jews are actually encouraged to party like it’s 1999. It’s an upside-down day, much like Mardi Gras, when men dress up as women and vice versa, when the meek are encouraged to be rowdy, when adults are supposed to act like kids, and when you are encouraged to poke fun at sacred cows (to mix a cultural metaphor, which seems appropriate in this case).

Purim of course has its serious legal obligations: Jews are required to hear the public reading of every word of the Megillat Esther, or the Book of Esther. But at the same time, by custom they are urged to interrupt the reading with cheers and boos, noise and music. Every time the name of the evil Haman is read, it is to be blotted out with graggers and kazoos and other noisemakers, which, if you think about it, could be the prototype instruments of New Orleans jazz. And by the end of the reading, according to the Talmud, you are supposed to have drunk enough schnapps such that you cannot tell the difference between “cursed be Haman” and “blessed be Mordechai,” which a scientific survey found to be equal to the exact level of drunkenness of the average Mardi Gras reveler.

New Orleans’s Mardi Gras celebrations date back to the early 19th century. By mid-century, social organizations, or “krewes,” had begun to form. They were men’s social clubs, like the Temple Brotherhood, that adopted mythologies, secret handshakes, and themes for their costumes. One such organization was Rex, whose king also acts as the official King of Carnival. The first such man thusly honored with the title “Rex” was Louis Solomon in 1872. Solomon, a prominent Jewish businessman, is said to have been a descendant of Haym Salomon, the financier of the American Revolution.

After the Civil War, things got worse for the Jews along with other victims of racial and religious prejudice. With the rise of Jim Crow and anti-immigrant sentiment in the early 20th century, Jews as well as blacks were banned from most of the New Orleans krewes.

Eventually blacks and Jews formed their own krewes. The first African-American krewe, Zulu, was founded in 1909, although its Mardi Gras parade route was confined to black neighborhoods well into the 1960s. Zulu’s approach was a Purim-like grotesquerie, in which participants appropriated the very look and behavior attributed to them by racist Southerners as a kind of mockery or send-up. They dressed according to the worst portrayals of the “savage” African, they wore blackface, and they handed out coconuts and spears to the crowd.

It was supposedly the sight of this cultural subversion in action, as well as the sound of a marching band playing klezmer — the New Orleans Klezmer Allstars — that inspired a young Jewish newcomer to New Orleans named L.J. Goldstein to form the modern-day Krewe du Jieux in 1995. And like the Zulus, they appropriated anti-Semitic iconography for their costumes, wearing fake hooked noses and horns, dressed as bankers and lawyers, and built a float that promoted the “Jieux World Order.” Instead of coconuts, they threw bagels.

And just as the establishment of the first synagogue in town eventually must lead to the establishment of a second, in order that Jews have a place in which they won’t set foot, so too did a group of members split off from the Krewe du Jieux in order to form the Krewe du Mishigas, bringing the secret Jewish history of Mardi Gras to its ultimate and perfect conclusion.

In a surprisingly under-reported story, one of Jerusalem’s chief rabbis, Rabbi Shlomo Amar issued a ruling on Monday that God must bring the messiah and expedite the ultimate redemption. The ruling was delivered during an all-night spiritual gathering of rabbis from the Chabad-Lubavitch movement and a recording of the moment was posted to YouTube (in Hebrew).

In the days preceding the ruling by Amar, close to 6,000 rabbis and Jewish community leaders attended the annual Kinus Hashluchim (International Conference of Chabad-Lubavitch Emissaries) in Brooklyn, NY. The Chabad-Lubavitch movement has emissaries who serve the Jewish people in over 75 countries around the world. Each year, they gather in New York for their annual conference.

After the official conference proceedings were concluded, Amar and others gathered at the Chabad-Lubavitch World Headquarters, also in Brooklyn, NY, for an informal farbrengen. A farbrengen is a get-together in the Chabad-Lubavitch world, where inspirational thoughts are shared and wordless spiritual tunes, called niggunim, are sung. Sweet foods, wine and other items are often served.

During this spontaneous gathering, and no doubt influenced by the heady success of the conference that had just concluded, [Putin’s Rabbi] Berel Lazar, one of Russia’s two chief rabbis, reminded Amar that 25 years ago, the Rebbe, Rabbi Menachem Mendel Schneerson, the last head of the Chabad-Lubavitch movement, who passed away in 1994, had asked Amar to issue a psak din (a formal rabbinic ruling) on the issue of the redemption of the Jewish people.

Twenty five years later, at this gathering in the early morning hours of November 9, 2015, Amar agreed that the time had come to rule that God must hasten the arrival of the messiah.

In the presence of dozens of colleagues and holding the hands of the two men sitting closest to him, Amar pronounced, “We hereby rule according to the demand of the audience – we see the plaintiff but can’t see the defendant – that God Almighty speedily bring an end and reveal the Moshiach (messiah) in front of our eyes in actuality.”

Despite the late hour, his statement was greeted with a hearty “Amen!” from the crowd. Immediately after, the crowd began singing “We want Moshiach now! We don’t want to wait!” These words come from a song that Lubavitch children are taught to sing from a very early age.

How is it possible that a rabbi, even one of the chief rabbis of Jerusalem, can make a ruling in Jewish law that obligates God? Breaking Israel News posed this question to senior Chabad Rabbi Uri Kaploun who said, “All that comes to mind is the axiom in Chazal (the Jewish sages) that Lo BaShamayim Hi (it is not in Heaven): once the Torah was given, the earthly court makes the rulings, and the Heavenly Court is, as it were, bound by them.
